February 18, 2014: New Hampshire DWI Case Example: A multi-department paramilitary police unit (the “Southern New Hampshire Special Operations Unit” or “SNHSOU”) drove into a neighborhood in Salem, New Hampshire with military style vehicles in order to execute search warrants for drugs.  Their operation ultimately led to one arrest of an old woman who had a bag of drugs.  15 minutes into their invasion of this residential street, however, during late afternoon hours, a citizen drove into a parking lot to meet his child.  Finding this somehow suspicious, the paramilitary cops ordered this citizen out of his vehicle at rifle point.  They made the citizen turn around, kneel on the ground, and they tie wrapped his hands behind his back.

They ordered the citizen to stand up and walk backwards toward them after a lengthy period of time kneeling on the pavement.  The Paramilitary police officers noticed the citizen was “unsteady on his feet”, the precursor to nearly every DWI arrest in New Hampshire.  The paramilitary police held the citizen in custody for twenty minutes until Salem Police arrived.  Once the Salem police arrived, the citizen was led through a predictable battery of field sobriety tests.    The officer reported that this citizen “failed” all three field sobriety tests: the HGN test, the “walk and turn test” and the “one leg stand” test.

Once back at the station, the officer requested that the citizen blow into a breath testing gadget.  The citizen agreed and blew .000.  Police usually assume you are on drugs if you pass a breath test and this officer was no different.  He asked this citizen to submit to a blood test, which the citizen agreed to do.  His blood test came back at .000 blood alcohol and there were no drugs of any kind present in his system.  This is an example of, among many other things, an unnecessary trampling of a citizen’s right to be left alone, and an epic failure of one officer’s interpretation of field sobriety tests.  Faced with dispositive proof that this citizen was sober, the state dropped this charge.

Note-this is one example of a recent New Hampshire DWI administrative license suspension hearing case result. It is not a guarantee of any particular result in any other case.
